What are Award Criteria?

The EU Public Procurement Directive requires that award criteria be linked to the subject matter of the contract and disclosed in the contract-notice or tender documents with their respective weightings. The most economically advantageous tender (meat) standard replaced the lowest-price-only rule for most EU contracts, meaning price must typically be one criterion among several. Other common criteria include quality (technical merit, methodology, staffing qualifications), environmental characteristics, social considerations, after-sales service, delivery time, and whole-life cost. Where price is the sole criterion, the authority must justify it, which effectively restricts lowest-price-only awards to commodity purchases where quality is fully standardised.

Award criteria are fixed once the tender documents are published and cannot be changed or weighted differently after submission. This is distinct from selection-criteria: selection criteria determine who is qualified to have their tender evaluated; award criteria determine who wins among those qualified. The two must not overlap: what is used at the selection stage cannot be re-evaluated at the award stage.

Why Award Criteria matter for bidders

Award criteria are the scoring blueprint for any EU tender. A supplier that reads the award criteria weighting before drafting its tender can build its proposal around the dimensions that earn the most points, rather than writing a general response and hoping for the best. In a procedure where methodology is weighted at 40 percent, price at 30 percent, and team qualifications at 30 percent, the methodology section is the most important document the supplier writes. The mark scheme drives everything. Suppliers should also note that any sub-criteria and scoring scales must be disclosed; if they are not, the award is likely to be successfully challenged. Checking that the authority has published all criteria and weightings before submission, and requesting clarification if they are unclear, protects the supplier's legal rights if it later disputes the outcome.

Can a contracting authority use price as the only award criterion?

The EU directive allows price-only criteria only where the specification is sufficiently detailed and standardised that quality differences between compliant tenders are negligible. Authorities must justify choosing price as the sole criterion, and it is uncommon outside purely commodity-based procurement.

Are award criteria fixed after the tender documents are published?

Yes. Award criteria and their weightings are fixed once the procurement documents are made available. Changing them after that point is a material modification that would require republication and a new submission opportunity.

Can an authority introduce award sub-criteria that were not in the original documents?

Sub-criteria that were not disclosed to tenderers cannot be applied in evaluation. EU case law consistently holds that all criteria and sub-criteria used to select the winner must have been communicated to tenderers in advance.
